Terms and conditions for CareClub App ApS
These terms and conditions apply to all agreements between CareClub App ApS (hereinafter "CareClub") and customers using the company's platform and services, unless otherwise agreed in writing.
CareClub is a booking platform (app and website) where practitioners create their services and available time slots, and customers can search, book, and pay for treatments directly through the app.
CareClub reserves the right to continuously modify, update, or further develop the platform to improve functionality, security, and user experience.
Treatments are carried out by practitioners affiliated with CareClub through the platform. CareClub acts as the employer and payment processor for the affiliated practitioners.
CareClub pays approximately 90% of the customer's payment to the respective practitioner. The remaining portion covers platform operations, administration, and insurance.
CareClub may suspend or remove practitioners from the platform in the event of serious complaints, rule violations, or other circumstances that conflict with CareClub's guidelines.
CareClub has obtained liability insurance covering treatments performed by practitioners through the platform.
In the event of serious issues related to a treatment, the customer may contact CareClub at hej@careclub.dk.
User account registration is done via phone number and SMS verification. The customer is responsible for providing a correct phone number.
The customer is also responsible for:
There is no fixed minimum age for creating an account, but booking requires a valid payment card. By creating an account and making a booking, the user confirms that they are entitled to enter into the agreement.
The customer may close their account at any time via www.careclub.dk/luk-konto.
Upon account closure, the customer may request deletion of personal data in accordance with GDPR. However, certain data may be retained to the extent required by applicable legislation, including the Danish Bookkeeping Act.
All prices are set by the individual practitioner and are always displayed including VAT in the app. Prices are stated in Danish kroner.
Payment flow: the amount is reserved on the customer's payment card upon booking. The amount is charged when the treatment begins. In the event of a no-show, payment is processed automatically.
In case of non-payment, CareClub reserves the right to:
Cancellation of a booked treatment must be made no later than 24 hours before the scheduled time.
For cancellations made less than 24 hours before the treatment or in the event of a no-show, full payment will be charged. These rules are set by CareClub and apply equally to all customers.
Practitioners may offer punch cards through the platform. The expiration date of the punch card is set by the individual practitioner.
A punch card is only valid at the practitioner or clinic that issued it and cannot be transferred or used at other practitioners.
By making a booking through CareClub, the customer accepts these terms and conditions, CareClub's privacy policy, and the applicable payment terms.
As bookings concern time-specific treatments, the statutory right of withdrawal does not apply, cf. section 18(2)(12) of the Danish Consumer Contracts Act. Instead, the cancellation rules in section 8 apply.
CareClub is responsible for the operation of the platform and correct payment to practitioners. Treatments are carried out by affiliated practitioners, and CareClub cannot guarantee specific treatment outcomes.
CareClub cannot be held liable for:
CareClub's total liability can never exceed the amount the customer has paid for the service within the last 12 months, unless otherwise required by mandatory legislation.
Complaints regarding a treatment should first be directed to the respective practitioner.
If a satisfactory resolution is not reached, the customer may contact CareClub at hej@careclub.dk. CareClub will assess the case and may suspend or remove practitioners in the event of serious issues.
CareClub may suspend or close access for:
In the event of a material breach, CareClub may terminate the agreement without notice.
CareClub processes personal data in accordance with applicable data protection legislation. Further information can be found in CareClub's privacy policy.
Upon closure of the customer's account, personal data will be deleted unless retention is required by applicable legislation, including the Danish Bookkeeping Act.
All rights to the app, software, content, design, text, graphics, and materials belong to CareClub or its partners.
The customer obtains only a non-exclusive, time-limited right to use the services in accordance with these terms and conditions. Material may not be copied, redistributed, or used commercially without written permission.
CareClub has the right to transfer, in whole or in part, its rights and obligations to a third party as part of operations, restructuring, or sale of the company.
These terms and conditions are governed by Danish law. Any disputes shall be resolved by Danish courts with CareClub's domicile as the venue, unless otherwise required by mandatory legislation.
These terms and conditions take effect from the date of publication and replace all previous terms.
